CWRU Law professors, alumnus author Amicus Brief on Hague Child Abduction Convention in Supreme Court case

Seven CWRU Law professors were the lead authors on an Amicus Brief submitted by the law school’s Cox International Law Center in August 2019 to the U.S. Supreme Court in Monasky v. Taglieri, a case about The Hague Child Abduction Convention.  

The brief argues that the Court should be guided by international and foreign judicial interpretations of The Hague Convention and that those precedents indicate that the Convention permits a finding of non-habitual residence under the facts of the case.  The case is scheduled to be argued at the Supreme Court in December 11, 2019.  

The brief was authored by Co-Dean Michael Scharf, Associate Dean Avidan Cover, Professor Andrew Pollis, Adjunct Professors Stephen Petras, Aleksandar Cuic and Theodore Parran, and alumnus David Carney.
