Jessie Hill's article "Recentering the Pregnant Body: Moving Beyond the Medicalized Framework in Abortion Advocacy," is forthcoming in the Harvard Journal of Law and Gender. Hill argues that abortion rights advocates have long treated abortion as primarily a medical issue, while minimizing its other dimensions, for example, its relationship to gender equality and religious freedom. While the medical approach has been advantageous in many respects, it has also led to several unfortunate consequences, including erasing the pregnant individuals who are most affected by abortion laws. Thus, Hill argues that abortion advocates looking to re-establish abortion rights in the wake of the Supreme Court's Dobbs decision should consider broadening the frame in which they speak and litigate about abortion rights beyond the medical one. This includes bringing different kinds of constitutional claims with different kinds of plaintiffs.
