Professors Adler and Flatt preview environmental cases in federal court

On Oct. 16, the U.S. Supreme Court heard oral argument in City and County of San Francisco v. Environmental Protection Agency, a challenge to the EPA’s use of “generic” prohibitions in Clean Water Act permits. On Sept. 24, professor Jonathan Adler moderated a webinar previewing the arguments and issues in the case, featuring professor Robin Kundis Craig of the University of Kansas and Andre Monette (Law 2006) of Best, Best & Kreiger. The webinar examined the legal arguments being made for and against the EPA’s position and the potential implications of this case for Clean Water Act enforcement, local governments, and water pollution control. Also on Oct. 16, professor Victor Flatt participated in the webinar examining current litigation over climate disclosure regulations adopted by the federal Securities and Exchange Commission and the state of California. Both sets of regulations aim to provide investors with more information about greenhouse gas emissions and climate-related risks, and both sets of regulations are currently subject to legal challenge in federal court. In the webinar, “Climate Disclosure Litigation: Examining Legal Battles Against California and the SEC,” Flatt was joined by attorneys Stephen Hall of Better Markets, Trent McCotter of Borden Gray PLLC, and Marc Marie of Americans for Prosperity.
