Telecom subsidy case is part of bigger push to curb agency power

Bloomberg TaxJonathan Adler, the Johan Verheij Memorial Professor of Law, discussed a federal appeals court decision that ruled against the FCC’s $8 billion program for poor and rural phone and broadband service, deeming it an unconstitutional delegation of Congress’ taxing authority to a non-governmental organization, and challenging federal agency power and decision-making delegation. “I don’t think it’s likely that we get a broad non-delegation holding,” he said.
