Supreme Court raises bar for future curbs on industrial air pollution
E&E News by Politico: Victor Flatt, the Coleman P. Burke Chair in Environmental Law and associate director of the Burke Center for Environmental Law, weighed in on the U.S. Supreme Court’s decision that could hamper future Environmental Protection Agency’s (EPA) efforts to combat dangerous air pollution that crosses state lines. He shared that the decision could complicate any future bid by the EPA to comply with the Clean Air Act provision that bars states from allowing industrial pollution that undercuts compliance in downwind areas beyond their borders.
