Efforts to trim agency power loom over Supreme Court
Politico: Jonathan Adler, the Johan Verheij Memorial Professor of Law, noted that the Supreme Court will hear cases challenging federal agency power under the nondelegation doctrine, which limits Congress from delegating policymaking to agencies. While conservative groups back the doctrine, Adler cautioned the court may not directly address it in these cases.
