FTC intends to ban noncompete clauses that bind 30 million US workers
ARS TechnicaJonathan Adler, the Johan Verheij Memorial Professor of Law, weighed in on a Federal Trade Commission rule proposal prohibiting employees from imposing noncompete clauses on workers, arguing that "non-competes constitute an unfair method of competition” and therefore violate Section 5 of the Federal Trade Commission Act. “This proposed rule sets up (a) potential legal challenge to the scope of FTC authority to issue substantive rules,” he said.
