Brennan Professor Emeritus of Law, said that President Trump cannot unilaterally issue the proposed $5,000 payments; Congress would have to appropriate more than $1 trillion. He noted the proposal isn’t technically vote-buying because it applies regardless of how recipients voted and said presidential immunity could make criminal prosecution unlikely.
