Brennan Professor Emeritus of Law, offered insights into the legal argument over a judge's decision to block a ruling that would ban THC drinks, stating the this state law violates the so-called dormant Commerce Clause of the federal Constitution. “In order for the judge to have issued even this temporary ruling, the judge had to have concluded that the challengers were reasonably likely to win this case on the merits once it plays out,” said Entin.
