As of Sept. 12, 2023, Case Western Reserve University and the Cleveland Clinic Foundation have entered into a Mutual Non-Disclosure Agreement (Protocol Sharing with Marking Requirement). This agreement allows for the mutual sharing of Institutional Review Board (IRB) protocols, Informed Consent Forms and other related documents between the two institutions. Please provide a copy of this CDA to anyone at CWRU who may disclose confidential information and/or materials (on purpose or inadvertently) so that the responsibilities and requirements covered by this agreement are fully understood. Some, but not necessarily all, of these requirements are:
- Requirements to mark information as “CONFIDENTIAL.” This includes all IRB Protocols, ICFs and other related documents.
- If you orally disclose confidential information, you must confirm in writing within 30 days that the orally disclosed information is CONFIDENTIAL.
- Requires any storage and handling of Cleveland Clinic materials and/or confidential information be treated with the same degree of care we treat our own confidential information with.
- Limits of use and dissemination of the material and/or confidential information; and stipulates you
- Cannot further disclose to third parties.
- Must return confidential information upon agreement or term termination/expiration.
- Time periods during which the materials/confidential information will be used or disclosed and must be protected:
- “Disclosure Period” is Sept. 12, 2023 through Sept. 11, 2028
- We may extend it at this time, but you need to verify that in 2028.
- “Disclosure Period” is Sept. 12, 2023 through Sept. 11, 2028
Confidentiality of any information shared under this agreement shall remain in effect for 7 years after initial disclosure date.
