Legal and Ethical Duties to Report, Warn, and Protect

This presentation is intended to enhance attendees’ ability to recognize situations that may engender legal or ethical duties to report behaviors that create risks to others in the healthcare context. It will discuss when a legal or ethical obligation exists to report to authorities, warn a potential victim and/or protect a potential victim, and what the difference between each of these actions is. The presentation will also discuss the gray zones in which healthcare and mental health providers may find themselves, and strategies for navigating these challenging situations. Finally, the presentation will identify supportive resources for addressing legal and ethical duties to report, warn, and protect.

Speaker Information

Hilary Mabel, JD is an Assistant Staff Ethicist and Regional Bioethicist (South) in the Center for Bioethics at the Cleveland Clinic. She supports the ethics programs at Akron General and Medina hospitals, as well as the ethics consultation service at Main Campus. Prior to this role, she completed a fellowship in Advanced Bioethics at the Cleveland Clinic. Prior to that, Ms. Mabel served as a Law Clerk to the Honorable Roy Dalton, Jr. in the United States District Court for the Middle District of Florida and then as an Associate at the law firm Jones Day. She holds a BA summa cum laude from the University of Florida and a JD from Harvard Law School. Ms. Mabel specializes in clinical ethics consultation, gender & bioethics, and reproductive ethics.
