Dean Michael Scharf was lead co-author of an Amicus Brief requested by the Appeals Chamber of the International Criminal Court (ICC) in The Prosecutor v. Bosco Ntaganda case.
The legal question the International court asked Scharf and his colleagues from the Public International Law & Policy Group to address in the brief is whether the term "attacks" under international humanitarian law and the ICC Statute includes looting a hospital immediately after the fighting in the Congo had ceased. This is the first Amicus Brief that Scharf, who won a national book of the year award last year for his book about Ad Hoc international criminal tribunals, has filed before the ICC.
